1.1 Agreement

These Terms of Service (“Terms”) govern your access to and use of mynottera.com and any purchase you make from Nottera.

By accessing or using the website or placing an order, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced in these Terms. If you do not agree to these Terms, please do not use the website or place an order.

1.2 Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract.

By placing an order, you represent and warrant that you meet these requirements and that all information you provide to us is accurate and complete.

1.3 Accounts

If you create an account with Nottera, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us promptly if you become aware of any unauthorized access to or use of your account.

1.4 Orders, Acceptance, and Cancellation

  • Order acceptance: When you place an order, you are making an offer to purchase the products listed in your order. A contract of sale is formed only when we send you an order confirmation or shipping confirmation. We reserve the right to accept, decline, limit, or cancel any order, in whole or in part, for any lawful reason.
  • Fraudulent or restricted orders: We may cancel or refuse orders that appear fraudulent, abusive, intended for unauthorized resale, unusually large, or that fail payment or identity verification. If we cancel an order that has already been paid for, we will refund the amount charged for the canceled items.
  • Quantity limits: We may limit the quantity of products that can be purchased by any individual, household, or order.

1.5 Pricing and Errors

All prices are displayed in U.S. Dollars (USD) and may change at any time without notice.

Although we make reasonable efforts to ensure that product descriptions and pricing information are accurate, errors may occasionally occur. We reserve the right to correct pricing, product description, availability, or other errors and to cancel any affected order, even if the order has already been confirmed or paid for.

If we cancel an affected paid order, we will issue a refund for the amount charged.

1.6 Payment

By submitting payment information, you represent that you are authorized to use the payment method provided.

You authorize Nottera and our payment processors to charge the total amount due for your order, including applicable taxes and shipping charges.

1.7 Product Information; Not a Medical Device

We make reasonable efforts to display our products, colors, specifications, and other information as accurately as possible. However, we do not guarantee that all website content is complete, current, or error-free.

Actual product colors may vary depending on your device, display settings, lighting conditions, and other factors.

Nottera products are consumer comfort products and are not medical devices. They are not intended to diagnose, treat, cure, or prevent any medical condition.

Any statements regarding comfort, support, alignment, ergonomics, or similar benefits are provided for general informational purposes only and do not constitute medical advice.

If you have a medical condition or specific health concern, please consult a qualified healthcare professional before using our products.

1.8 Reviews and User Content

If you submit reviews, photographs, testimonials, comments, or other content to Nottera, you grant Nottera a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, display, distribute, and otherwise use that content for marketing, advertising, promotional, and operational purposes.

You represent and warrant that:

  • You own or otherwise have the necessary rights to the content you submit.
  • Your content is accurate and not misleading.
  • Your content does not violate any applicable law or the rights of any third party.
  • Your content does not contain unlawful, defamatory, abusive, or otherwise prohibited material.

We reserve the right to remove or refuse to publish any user content at our discretion.

1.9 Acceptable Use

You agree not to:

  • (a) Use the website for any unlawful, fraudulent, abusive, or unauthorized purpose.
  • (b) Interfere with the operation, security, or integrity of the website or its systems.

The Nottera website and all content available through it, including trademarks, logos, names, text, graphics, photographs, images, videos, designs, software, and other materials, are owned by or licensed to Nottera and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you do not receive any ownership rights or licenses to our intellectual property.

You may access and use the website solely for lawful personal and non-commercial purposes, including viewing our products and making purchases.

1.11 Third-Party Links and Services

Our website may contain links to, integrate with, or rely on third-party websites, services, applications, or providers, including payment processors, analytics providers, advertising platforms, and other service providers.

We are not responsible for the content, availability, security, privacy practices, or policies of third-party services.

1.12 Disclaimer of Warranties

Except for any express Limited Warranty provided in our Warranty Policy and any rights or remedies that cannot be excluded or waived under applicable consumer-protection laws, the website and products are provided “as is” and “as available.”

To the maximum extent permitted by law, Nottera disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms is intended to exclude or limit any warranty, right, or remedy that cannot legally be excluded or limited under applicable law.

1.13 Limitation of Liability

To the maximum extent permitted by applicable law, Nottera will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunities, or goodwill arising out of or related to your use of the website or purchase or use of our products.

To the maximum extent permitted by law, Nottera’s total aggregate liability for any claim arising out of or relating to a product or these Terms will not exceed the amount you actually paid for the product(s) giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.

1.14 Billing Disputes and Fair Use

Billing Disputes

If you believe there is an error with a charge, please contact us first at hello@mynottera.com. We are committed to resolving billing issues promptly and typically respond within 24 hours.

Initiating a payment dispute or chargeback in bad faith, including after receiving the product or instead of using an applicable return or refund process, constitutes a violation of these Terms.

Where appropriate, we may contest such disputes with supporting evidence, including order records, tracking information, delivery confirmations, and communications.

We may also pursue amounts legitimately owed to us and, where permitted by law, decline future transactions or services.

Return and Promotion Fair Use

We reserve the right to refuse or limit orders, returns, refunds, or discounts where we reasonably believe there has been repeated, excessive, fraudulent, or bad-faith activity, including false claims, unauthorized resale, or promotion abuse.

Verification

We may request identity or payment verification when reasonably necessary to protect our customers and business from fraud or unauthorized activity.

We may cancel orders that cannot be reasonably verified.

1.15 Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Nottera and its affiliates, officers, directors, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your breach of these Terms.
  • Your misuse of the website or our products.
  • Your violation of applicable law.
  • Your violation of the rights of Nottera or any third party.

1.16 Dispute Resolution; Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT.

Informal Resolution First

Before initiating any formal legal proceeding, you agree to contact us at hello@mynottera.com and make a good-faith effort to resolve the dispute informally.

You agree to allow at least 30 days for informal resolution before initiating formal proceedings, unless applicable law provides otherwise.

Binding Individual Arbitration

Except where otherwise prohibited by applicable law, any dispute, claim, or controversy that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, rather than in court.

However, either party may bring an individual claim in an appropriate small-claims court if the claim qualifies for that court.

Class Action Waiver

To the maximum extent permitted by law, disputes will be resolved only on an individual basis.

You and Nottera each waive the right to participate in a class action, collective action, representative action, or consolidated proceeding involving claims covered by this arbitration provision.

Arbitration Opt-Out

You may opt out of the arbitration agreement within 30 days of first accepting these Terms.

To opt out, email hello@mynottera.com with your full name, the email address or order number associated with your purchase, and a clear statement that you are opting out of the arbitration provision.

Time Limit for Claims

To the maximum extent permitted by applicable law, any claim arising out of or relating to these Terms, the website, or your purchase must be filed within one (1) year after the claim first arises.

Applicable Law

If any portion of this dispute-resolution provision is not permitted or enforceable under applicable law, that portion will not apply to you, and the remaining provisions will remain in effect to the extent permitted by law.

1.17 Governing Law

These Terms are governed by the laws of the state in which Nottera is established, without regard to its conflict-of-law principles, except to the extent that applicable consumer-protection laws provide otherwise.

This provision is subject to the dispute-resolution provisions in Section 1.16.

1.18 Changes to These Terms

We may update or modify these Terms from time to time.

Any changes will become effective when posted on the website with a new “Last updated” date, unless otherwise required by applicable law.

Your continued use of the website or purchase of products after the updated Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by law.

1.19 Force Majeure

Nottera will not be responsible for delays, interruptions, or failures to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, terrorism, strikes, labor disputes, carrier disruptions, customs actions, pandemics, epidemics, government actions, or other similar events beyond our reasonable control.

1.20 Miscellaneous

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Nottera may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction.

These Terms, together with the policies expressly referenced in them, constitute the entire agreement between you and Nottera regarding your use of the website and purchase of our products, except where applicable law requires otherwise.
